Mach One Transport Terms & Conditions Cancellation Policy A Cancellation fee equal to the total trip cost, including tax and gratuity, will be charged for any cancellation that is made less than 2 (two) hours before the scheduled pick up time. A Cancellation fee equal to the total trip cost, including tax and gratuity, will be charged for any cancellation that is made less than 7 (seven) days before the scheduled pick up time for all charter arrangements, (Weddings, Proms, Bar/Bat Mitzvahs and Concerts). Mach One Transport is not responsible for passenger flights, which are missed, cancelled, diverted, and delayed or any other incident that results in failure to comply with the required cancellation policy. We will exact our best effort to fulfill client needs, in these instances, subject to wait time fees or late cancellations and re-bookings, without detriment to other reserved clients. No-Show Policy A no-show will be deemed if the passenger fails to be at the designated pickup location 31 (thirty-one) minutes after the designated pickup time. If for any reason you cannot locate your chauffeur, call Mach One Transport at 954-638-3140. To avoid being billed as a no-show, do not leave your location without contacting Mach One Transport. A no-show fee equal to the trip cost plus applicable waiting time, tolls, parking, and gratuity will be charged when the passenger fails to show at the designated time and location for which a reservation has been made. The re-scheduling of your service is subject to availability. Deposit Policy A 25% (twenty-five percent) deposit on a major credit card is required for all reservations. Reservation is not confirmed until deposit and Service Agreement are received. Balance will be billed to customer's credit card upon completion of job. Sales tax plus an 18% (eighteen-percent) gratuity are charged on all reservations. A non-refundable deposit of 50% (fifty-percent) is required on all charter arrangements (Weddings, Proms, Bar/Bat Mitzvahs and Concerts). A credit card authorization form and Service Agreement are also required before reservations are accepted. In the event that Mach One Transport is unable to honor a reservation due to circumstances beyond our control, all deposits will be refunded in full. Payment Procedures Cash or Credit Card (American Express, Visa, MasterCard and Discover Card) is the standard accepted and agreed upon payment method. Charges will reflect costs incurred while performing transportation services for reservations placed with Mach One Transport by the customer, its agents, and any individuals requesting transportation as an authorized employee of the customer and will reflect costs including but not limited to trip charges, tolls, parking, gratuity, fuel surcharge and cellular telephone charges. Upon credit approval, Mach One Transport will invoice clients upon completion of the reserved transportation with payment due upon receipt of invoice. Invoicing is contingent upon an executed Credit Card Authorization Form to be held on file to apply charges not honored in a timely manner. A late charge of 10% (ten-percent) will be added to all outstanding balances in excess of 30 (thirty) days from the invoice date. Reservations Reservations, changes or cancellations may be made by calling our reservation number…954-638-3140. It is suggested that the Customer supplies this reservation number to all traveling passengers. Availability of limousine past reserved time is not guaranteed. Mach One Transport provides a 15 (fifteen) minute grace period on all reservations. After 15 (fifteen) minutes, customer accepts responsibility for overtime charges incurred at the current published rates. Prohibited Items The use of any illegal substance is prohibited in the limousines. The possession or consumption of alcohol by any passenger under the age of 21 is prohibited. Any breach of this policy will result in immediate termination of services and payment due in full for entire reservation. In this instance, driver may terminate services immediately or return passengers to the point of initial pickup. Customer Responsibility Customer accepts financial responsibility for any and all damages resulting from improper use of the limousine and its contents, including but not limited to, audio/video equipment, lighting, exterior and interior components, including upholstery. Repairs for damages will be billed to customer's credit card. Special Amenities Our professional chauffeurs provide bottled water and ice for all travelers. All cars are equipped with AM/FM/CD, DVD and local television. Indemnification and Hold Harmless Mach One Transport and Customer each agree to defend, indemnify, and hold harmless the other party from and against all claims, actions or causes of action, liabilities, including reasonable attorneys' fees, and costs arising from the defense of any claim, action, cause of action or liabilities arising out of or resulting from any act taken or committed by Mach One Transport or Customer pursuant to the performance of each party's obligations hereunder. Mach One Transport and Customer each agree to defend, indemnify, and hold harmless the other party for any claim, action, cause of action, and liabilities which may be asserted by third parties arising out of the performance of either party's obligations pursuant to this contract, except for the willful misconduct or gross negligence of the other party. Insurance Mach One Transport and Customer shall obtain and maintain and provide evidence of insurance upon request in amounts sufficient to provide coverage for any liabilities arising out of or resulting from the respective obligations pursuant to this agreement. Dispute Resolution If there is a dispute concerning the quality of service and / or any incidents thereto, the parties agree that they shall resolve such dispute by good faith negotiation or common law binding arbitration. Waiver If one party agrees to waive its right to enforce any term of this agreement, it does not waive its right to enforce such term or any or all other terms of this agreement at any other time. Mach One Transport does not guarantee arrival at or departure from any point at a specific time due to circumstances beyond its control such as accidents, breakdowns, traffic and road conditions, storms, etc. and shall not be held liable for claims resulting in delays from such conditions. Mach One Transport reserves the right to substitute the contracted vehicle in the event of such an occurrence mentioned above with a vehicle of like kind and quality. Customer waives all claims for consequential damages and agrees that liability shall be limited to the costs accrued to Mach One Transport for the disputed service. Governing Law This agreement shall be governed by and construed under the laws of the State of Florida. If any provision of the contract is unenforceable under applicable law, the remaining provisions shall continue in full force and effect. Attorneys' Fees In the event any legal action is taken by either party against the other party to enforce any of the terms and conditions of this agreement, it is agreed that the unsuccessful party to such action shall pay to the prevailing party therein all court costs, reasonable attorneys' fees, and expenses. Acceptance If agreement as stated above meets with the approval of Customer, it will be considered accepted in its entirety unless written notice is received within 5 days by Mach One Transport in connection with a specific reservation..
